By purchasing a Tribute Tile or using our services, you agree to these terms. If you do not agree with any part of these terms, please do not use our service.
1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of Tribute Tiles' website, products, and services (collectively, the "Service"). By creating an account, purchasing a product, or accessing our Service, you agree to be bound by these Terms and our Privacy Policy.
2. Service Description
Tribute Tiles provides physical memorial tiles with embedded QR codes that link to digital memorial pages. Our Service includes:
- Physical QR code memorial tiles
- Cloud-hosted memorial pages with photos, videos, and text
- Visitor condolence and memory sharing features
- Privacy controls and content moderation tools
3. Account Registration & Eligibility
3.1 Age Requirement: You must be at least 18 years old to create an account.
3.2 Accurate Information: You agree to provide accurate, current information during registration and keep it updated.
3.3 Account Security: You are responsible for maintaining the confidentiality of your password and account.
3.4 One Account Per Person: Each individual may maintain only one account unless authorized by us.
4. Product Purchase & Payment
4.1 Pricing: All prices are displayed in Australian Dollars (AUD) unless otherwise specified. Prices are subject to change without notice, but changes won't affect orders already placed.
4.2 Payment: Payment is processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method.
4.3 Taxes: Prices include applicable taxes. You are responsible for any additional taxes required in your jurisdiction.
4.4 Order Confirmation: Once payment is confirmed, you'll receive an email with your QR code(s) and activation instructions.
5. Shipping & Delivery
5.1 Processing Time: Orders are processed within 2-3 business days.
5.2 Shipping Time: Physical tiles are shipped via standard international post and typically arrive within 7-14 business days.
5.3 Digital Access: Your QR code and memorial page are immediately available after purchase—you don't need to wait for the physical tile to arrive to start building your memorial.
5.4 Shipping Address: You are responsible for providing an accurate shipping address. We are not liable for delays or non-delivery due to incorrect addresses.
5.5 Free Shipping: We offer free worldwide shipping on all tile orders.
6. Refund & Return Policy
6.1 Digital Services: Since you receive immediate access to your QR code and memorial page, digital services are non-refundable after purchase.
6.2 Physical Products: If your memorial tile arrives damaged or defective, contact us within 30 days of delivery for a free replacement.
6.3 Satisfaction Guarantee: If you're not satisfied with the quality of your memorial tile, we'll work with you to make it right.
6.4 Cancellation: You may cancel your order within 24 hours of purchase for a full refund, provided the physical tile has not shipped.
7. Content Ownership & License
7.1 Your Content: You retain all ownership rights to content you upload (photos, videos, text). By uploading content, you grant us a license to store, display, and transmit that content solely for the purpose of providing our Service.
7.2 Content Responsibility: You are solely responsible for the content you upload and share. You represent that you have all necessary rights and permissions.
7.3 Our Platform: All intellectual property rights in the Service itself (design, code, trademarks) remain our exclusive property.
8. Acceptable Use Policy
You agree NOT to:
- Upload illegal, offensive, defamatory, or inappropriate content
- Violate any person's privacy or intellectual property rights
- Use the Service for commercial advertising or spam
- Attempt to hack, disrupt, or reverse-engineer our platform
- Share login credentials or allow unauthorized access to your account
9. Content Moderation
While we don't pre-screen user content, we reserve the right to remove or disable access to any content that violates these Terms or applicable laws. Memorial owners can also moderate contributions to their memorials.
10. Service Availability
10.1 Uptime: We strive for 99.9% uptime but cannot guarantee uninterrupted service.
10.2 Maintenance: We may perform scheduled maintenance, during which the Service may be temporarily unavailable.
10.3 Updates: We may update or modify features without prior notice, but will maintain backward compatibility where possible.
11. Data Backup & Loss
We perform regular automated backups. However, you are encouraged to maintain your own backups of important content. We are not liable for data loss due to technical failures, user error, or circumstances beyond our control.
12. Account Termination
12.1 By You: You may delete your account at any time through your account settings. All memorial data will be permanently deleted within 30 days.
12.2 By Us: We may suspend or terminate accounts that violate these Terms, without prior notice or liability.
12.3 Effect of Termination: Upon termination, your access to the Service will cease, and associated memorials will become inaccessible.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(a) Tribute Tiles is provided "AS IS" without warranties of any kind, express or implied.
(b) We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
(c) Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
(d) We are not responsible for user-generated content, third-party services, or external links.
14. Indemnification
You agree to indemnify and hold Tribute Tiles harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
15. Dispute Resolution
15.1 Governing Law: These Terms are governed by the laws of New South Wales, Australia.
15.2 Informal Resolution: Before filing any legal action, you agree to contact us to seek informal resolution.
15.3 Jurisdiction: Any legal proceedings must be brought in the courts of Sydney, New South Wales.
16. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or a prominent notice on our website at least 30 days before they take effect. Continued use after changes indicates acceptance of the new Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tribute Tiles.
